Welcome to Fox Wurx. These Terms & Conditions ("Terms") govern your use of our website and the purchase of products from Fox Wurx. By accessing our website or placing an order, you agree to these Terms.
1. Products
Fox Wurx manufactures and sells custom and standard products. Due to the nature of manufacturing, slight variations in color, finish, engraving depth, and appearance may occur. These variations are considered normal and are not defects.
2. Custom Orders
Many Fox Wurx products are personalized or custom engraved.
Customers are solely responsible for reviewing all names, phone numbers, spelling, dates, and other customization details before submitting an order.
Once production begins, custom orders cannot be canceled or changed.
Fox Wurx is not responsible for errors submitted by the customer.
3. Pricing
Prices are subject to change without notice.
We reserve the right to correct pricing errors, cancel orders resulting from incorrect pricing, or refuse service at our discretion.
4. Payment
Payment is required before production or shipment unless otherwise agreed in writing.
Orders are processed only after payment has been successfully authorized.
5. Shipping
Estimated production and shipping times are estimates only and are not guaranteed.
Once an order has been transferred to the shipping carrier, Fox Wurx is not responsible for shipping delays caused by the carrier, weather, customs, labor disputes, or circumstances beyond our control.
Customers are responsible for providing an accurate shipping address.
6. Returns & Refunds
Because personalized products are made specifically for each customer, custom orders are non-returnable and non-refundable except when:
The wrong product was shipped.
The product arrives damaged.
The engraving does not match the information provided in the order due to our error.
Claims must be submitted within 14 days of delivery and may require photographs of the product and packaging.
7. Product Use
Customers are responsible for determining whether a product is appropriate for its intended use.
Fox Wurx is not responsible for damage, injury, or loss resulting from misuse, modification, improper installation, abuse, neglect, or normal wear and tear.
8. Recovery Tags
Recovery tags are intended to increase the likelihood that a lost item may be returned.
Fox Wurx does not guarantee the recovery of lost property or that a finder will contact the owner.
9. Limited Warranty
Fox Wurx warrants its products against defects in materials and workmanship at the time of delivery.
This warranty does not cover:
Normal wear
Cosmetic scratches
Abuse
Accidents
Improper use
Unauthorized modifications
Damage caused after delivery
Our sole obligation is, at our discretion, to repair, replace, or refund the purchase price of a defective product.
10. Limitation of Liability
To the fullest extent permitted by law, Fox Wurx shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, loss of use, loss of business, or loss of property arising from the use of our products or website.
Fox Wurx's total liability for any claim shall not exceed the amount paid for the product giving rise to the claim.
11. Intellectual Property
All logos, product designs, photographs, graphics, website content, and other intellectual property are owned by Fox Wurx unless otherwise noted.
No material may be copied, reproduced, modified, or distributed without prior written permission.
12. User Content
By submitting artwork, text, logos, or engraving requests, you represent that you own the necessary rights or have permission to use that content.
You agree to indemnify and hold Fox Wurx harmless from any claims arising from customer-submitted content.
13. Privacy
Your use of our website is also governed by our Privacy Policy.
14. Website Availability
We strive to keep our website accurate and available but do not guarantee uninterrupted access or error-free operation.
We reserve the right to modify, suspend, or discontinue any portion of the website without notice.
15. Force Majeure
Fox Wurx shall not be responsible for delays or failure to perform caused by events beyond our reasonable control, including natural disasters, severe weather, fire, cyberattacks, supply chain disruptions, labor shortages, government actions, pandemics, or shipping interruptions.
16. Governing Law
These Terms shall be governed by the laws of the State of Florida, without regard to conflict of law principles.
Any legal action arising from these Terms shall be brought in a court of competent jurisdiction located in Florida.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
18. Changes to These Terms
Fox Wurx reserves the right to modify these Terms at any time. Updated Terms become effective upon posting to this website.
Continued use of the website constitutes acceptance of any revisions.
